Harvard: Home Improvement to Trend Up in Late 2012  
After a slow beginning, homeowners should begin spending more on improvements later in 2012, according to the Leading Indicator of Remodeling Activity (LIRA) released Thursday by the Remodeling Futures Program at the Joint Center for Housing Studies of Harvard University.

Also, if the momentum continues to build in the latter part of 2012, remodeling activity would be on course to end the year on a positive note.

“We’re beginning to see some hopeful signs in the economy, and the housing market is finally starting its slow recovery,” said Eric Belsky, managing director of the Joint Center. “That should prove helpful for home improvement spending as the year progresses.”

“Sales of existing homes have been increasing in recent months, offering more opportunities for home improvement projects,” said Kermit Baker, director of the Remodeling Futures Program at the Joint Center. “As lending institutions become less fearful of the real estate sector, financing will become more readily available to owners looking to undertake remodeling.”


BR-111 Ordered to Pay Triangulo Nearly $1.56 Million  
A U.S. District judge in Florida on Jan. 5 ordered BR-111 Imports & Exports Inc. (Medley, Fla.) to pay Triangulo Flooring and Panels (Curitiba, Brazil) nearly $1.56 million as part of an arbitration settlement reached in September 2010.

The arbitration award comprises about $1 million for unpaid invoices, $250,280 for interest on those invoices, and $300,472 for Triangulo's attorneys' fees and a portion of arbitration costs. The award also stipulates that Triangulo must pay BR-111 $42,596 for outstanding warranty claims and interest on those claims.

The dispute started in October 2008. Until then, Triangulo was a private label supplier of engineered wood flooring for BR-111. In a Dec. 15, 2010, press release, BR-111 said that after the two companies severed ties, BR-111 ceased distributing any product under the Triangulo trademark. However, Doug Leigh, Triangulo's director of operations in North America, has said that even after the two companies split, BR-111 continued branding product as "Triangulo Engineered" but sourced it from other manufacturers. Leigh said this product was the one for which customers were submitting warranty claims.

In addition to the payment, the final award, issued by Judge William Hoeveler of Florida's southern district, determined that Triangulo is the rightful owner of the trademark "Triangulo Engineered" and that BR-111 has no right to use the mark.

A final award in the dispute was arbitrated and then entered Sept. 27, 2010. Triangulo took court action to enforce the arbitration award, but on Dec. 9, 2010, BR-111 asked the court to vacate the award, claiming it was denied due process during the arbitration proceeding. Hoeveler heard final arguments from both parties on Dec. 7. "BR-111 has failed to demonstrate any basis for vacating the Final Award," Hoeveler wrote.

"We are pleased with the result, especially because an arbitration tribunal and now the courts have both agreed that Triangulo owns our brand of Triangulo Engineered products," said Doug Leigh, Triangulo's director of operations in North America. "While the outstanding receivables were also a point of the arbitration and also upheld, we are most excited that our brand, Triangulo Engineered, can again be associated with quality products."

BR-111 President Ricardo Moraes said his company has already filed an appeal of the court's latest decision. To file an appeal in Florida's southern district, an appeal bond of 110% of the judgment must be posted, which in this case is about $1.7 million. Moraes declined to comment further. To date, Florida's southern district court has not received BR-111's appeal.

Regarding the $42,596 BR-111 was awarded for warranty claims and interest, Hoeveler wrote, "BR-111 presumably presented full support during the arbitration process as to each of the warranty claims it advanced."

Illegal Logging Down Across the Globe
LONDON — Tougher enforcement and strict new rules have led to a dramatic drop in illegal logging, sparing woodland in Cameroon, national parks in Indonesia and rain forests in the Amazon, a British think tank says.

Worldwide, an international clampdown on unlawfully harvested timber has helped protect up to 42 million acres of forest over the past few years — roughly the same area covered by the state of Illinois, according to a report published Thursday by the London-based Chatham House.

Since 2002, the report said, total global production of illegal timber has fallen by nearly 25 percent.

"We're a quarter of the way there," said Sam Lawson, one of the report's authors. He expressed the hope that newer regulations — such as a European law passed last week that will ban the import of illegal timber by 2012 — would cut the amount of illegal logging even further.

"A lot of the action that's been taken happened recently and can't be expected to have been trickled down to the level of the forest yet," he said.

Much heads West as furniture
A big chunk of that timber is processed in China and makes its way to the West in the form of plywood and furniture. The U.S., the U.K., Japan, France, and the Netherlands spent $8.4 billion buying illegally harvested wood in 2008, the report said.

Illegal logging in the Amazon has already been cut by between 50 percent and 75 percent, with similar drops recorded in Indonesia and Cameroon, the report found.

U.S. adds 290,000 jobs in April. “This is unambiguously a strong report for growth implications,” James O’Sullivan, chief economist at MF Global, said. “It adds to the evidence that the pickup in growth is leading to a clear-cut pickup in employment. It is very clear there has been a bounce here, and momentum has been up.” With revisions on Friday, April was the fourth consecutive month that the economy added workers (a revised 230,000 jobs were added in March, instead of 162,000), the job market still has a long way to go before it can be counted on to provide a base for a sustained economic recovery. Arboritec Holding (Jorlanda, Sweden) has formed a U.S. subsidiary, Arboritec USA (Greenwood Village, Colo.). Arboritec USA offers finish, sealer, maintenance and recoat products and is seeking additional distribution partners. Ron Peden, Mark Meglowski and Gerry Mueller head the company. Shaw Industries Group Inc. (Dalton, Ga.), a subsidiary of Berkshire Hathaway, has acquired the privately owned Anderson Family of Companies (Clinton, S.C), which includes Anderson Hardwood Floors, for an undisclosed amount. Anderson had previously manufactured select products for the Shaw alliance. "Anderson really represents the mid- to high-end field of the market in engineered wood, and they're leaders on styling and innovation, so we think there's a lot of synergy between the two companies," said Vance Bell, CEO of Shaw Industries Group Inc. With the acquisition, there will be no personnel changes to Anderson management. Shaw will give financial backing to the Anderson brand, and Anderson's existing product lines will continue to be sold only through its established circuit of distributors. "This really allows the Anderson family to take their chips off the table," said Don Finkell, president and CEO of Anderson Hardwood Floors. "[Shaw] resources will potentially be placed behind Anderson. In the long term, I think it will help us be competitive in the marketplace.

Armstrong World Industries (Lancaster, Pa.) has clarified a previously announced price increase. There will be a 5 to 7 percent price increase on solid hardwood flooring products shipped in Canada or the U.S. on April 1; prices for its engineered flooring products will raise 1 to 4 percent. The company's Daniel Call attributed the increases to rising lumber and energy costs, poor weather, scarce raw material, and increased demand due to flooring mills increasing inventory. "We believe further raw material inflation is likely in the coming months," he said. 2-22-2010
